GENERAL TERMS

These are the general terms of hiring a bicycles at REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228). However the full Terms & Conditions of Bicycle Hire are set out below and these supersede the general terms. 

  • It is hereby agreed as follows: Deià Activity rent bike reserved by prior reservation by online booking on the website, telephone or email, or hired directly at our shop in Deià, Archiduque Luis Salvador nº 5.

  • During the reservation process by online booking on the website, telephone or email, or directly at the shop, you are accepting our hire conditions, which you can find on our online website. Placing the booking is enough to accept all rules and hire terms, even without a signed contract. The contract is automatically considered signed once the order is placed. Once you have placed the order, you are fully responsible for adhering to any terms and conditions from Deia Activity S.L. regarding bike hire and tours.

  • REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228) are not responsible for injury or damages caused to/by the client during the hire period.

  • THE BIKES ARE NOT INSURED. The hiree is fully responsible for incidental theft or failure to return a cycle.

  • As an option, you can apply for special service "Partial coverage of damage" from REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228). Conditions for "Partial coverage of damage" for bike damage you can find in the section "Terms and Conditions"

  • We are provided helmets for your safety for free upon request.

  • All cycles come with one spare tube, levers, multitool, and a pump with the hire. We are not charging you if the tube is used. Any other items (like a multitool, tire levers, pump) not returned will incur a charge of €20 per item not returned.

  • All cycles are presented in immaculate working order set up by professional mechanics, and, whilst REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228) accepts general wear and tear during hire.

  • REYNES CYCLING could organize the emergency shuttle for clients. In the event of technical problems due to the fault of REYNES CYCLING, no transfer compensation will be charged. In all other cases, compensation for the transfer is negotiated and charged individually.

  • Theft and damage caused to any cycle will be charged to the hiree. This cost will amount to the loss incurred to REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228), and not the retail value of any cycle part or frame.

  • 30% deposit payment must be made at the time of booking. We are applying refunds based on "Refund conditions" (see the section about refunds).

  • Cancellations within two weeks prior to commencement or “no-shows” are charged at the full hire price.

  • REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228) shall have no liability to you if we are unable to fulfill a Booking due to an event of Force Majeure. If REYNES CYCLING BIKE RENTAL (Deia Activity S.L., Cif B16607228) cannot fulfill your booking, our liability to you shall not exceed the agreed cost of the hire. In cases of Force Majeure/Acts of God cancellations will not be permitted but it will be possible to reschedule any booking to a later date.

  • If a person or group reserves a private guided ride, tour, or cycling camp, the Client(s) is/are fully responsible for any kind of material or health damage or risk that may occur during the ride. As a professional provider, we take steps to minimize all risks associated with the activity, but it is important for the Client(s) to understand that cycling is a potentially dangerous sport, especially on open roads.

TERMS & CONDITIONS OF BICYCLE HIRE

CYCLE HIRE TERMS AND CONDITIONS

1.1 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) aim to provide high quality specialist bikes for hire. To achieve this at a reasonable cost we ask our customers to treat the equipment responsibly.

1.2 Bikes and equipment can only be hired from REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) on completion of a Hire Agreement Form or by accepting our hire conditions on our online booking portal. B reserves the right to take the customer's Credit Card details to hold as security until the bike is returned in the condition it was hired out in. Upon acceptance of these Terms & Conditions, a binding contract is formed between REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) and the hiree. REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) reserve the right not to accept or to fulfill a Booking.

1.3 All Bookings are subject to availability. When a Booking is made by one person on behalf of another person or people that person confirms to REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) that he or she has the authority to make such a booking.

1.4 The Hire period commences on the day the cycle(s) and equipment is collected or dispatched to you and continues until the cycle(s) and equipment is returned to the business premises of REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228).

2. HIRER'S TERMS AND CONDITIONS

2.1 You are responsible for ensuring that you are physically fit enough to undertake cycling any distance or compete in events using REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) or Equipment you have booked. REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) does not accept any responsibility for your failure to complete your Hire period due to lack of fitness, illness or injury. REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) does not accept liability for death, personal injury, loss or damage to personal effects to any participant, nor can REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) accept any responsibility for delays or changes to your period of Hire due to weather, strikes, war, terrorism or other causes.

 2.2 You accept that cycling on a public highway and competition on such carries its own risks and you have made your booking on the basis that you undertake the Hire at your own risk. You understand and accept that wearing of cycle helmets is mandatory at all times when riding in Spain.

2.3 You will ride your cycle responsibly at all times. You will not hold REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) responsible for any loss, damage or injury including death to persons or property with regard to the use of the cycle(s) and equipment hired. You accept responsibility to Indemnify REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) against any claim, interest, demand or expense in respect of such injury or damage.

2.4 You will ensure that you have suitable Insurance cover at all times during the period of your hire. REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) may offer a special service "Partial coverage of damage" for bike damage and only physical damage for parts, frame, wheels or accessories, excluded life and health coverage.

2.5 You are responsible for all cycles and equipment hired or loaned and it your responsibility to keep these items safe from damage, loss or theft, use it in a proper manner and not subject it to any misuse or unfair wear and tear.

2.6 Any damage caused due to crash or neglect is the Customer’s responsibility and will be charged for except situations, when Customer bought a special service "Partial coverage of damage". 

2.7 You will notify REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) immediately of any loss, damage or theft to the hired cycles or equipment however caused. You will be responsible for paying REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) the costs of repair and parts replacement for any such loss, damage or theft.

2.8 You will not offer for sale, sell, dispose, mortgage, lend, pledge or otherwise part with possession of the hired cycle(s) or equipment.

2.9 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) staff are usually available by phone or email to help out with any problems during the hire period; however it is the customer’s responsibility to assemble, set up and keep a check on the bike they have hired. Whilst REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) will always do it’s best to have staff available during the hire period this cannot be guaranteed.

2.10 Every Customer could apply for their hire a special service "Partial coverage of damage" with a payment fee for every booking. 

2.11 If the customer bought and made the payment (100% payment of 30% required booking deposit), the Customer automatically applied the Terms and conditions of a special service "Partial coverage of damage". The final amount of compensation will be calculated with the following rules:

"Total compensation" = "Costs of repair or replacement" minus "Partial coverage of damage". 

Explanation: 

Costs of repair for damaged bicicle: 743,50 EUR

Partial coverage of damage Standard (on 27.01.2023): 300,00 EUR

Total compensation: 443,50 EUR

On 27.01.2023 the amount of "Partial coverage - Standard" is 300,00 EUR. This amount could be revised for a new signed agreements.

On 1.01.2024: Added Packages “Pro” (1000 EUR coverage) and “Team” (2000 EUR coverage and assistance”

2.12 The hirer agrees not to make any significant modifications to the rented bike's components without prior authorization from Reynes Cycling Bike Rental ("the Rental Company"). This includes but is not limited to changes to the frame, drivetrain, brakes, suspension, and wheels.

2.13 If the hirer wishes to make any changes to the bike components, they must first contact Reynes Cycling Bike Rental to request approval. The Rental Company will assess the proposed modifications and, if deemed appropriate, arrange for a qualified mechanic to perform the changes.

2.14 Any modifications made to the bike components without prior approval from the Rental Company are strictly prohibited. If unauthorized modifications are made and result in damage to the bike or other losses (such as rendering the bike unfit for rental to subsequent clients), the hirer will be held responsible for any resulting compensation or repair costs.

2.15 Any modifications to the bike that decrease its value or result in damage to its components will be considered as physical damage to the bike. The hirer will be liable for any associated repair or replacement costs according to the rules outlined in the Bike Hire Terms.

2.16 If it is impossible for the hirer to obtain prior approval for a necessary modification due to extenuating circumstances, they must notify Reynes Cycling Bike Rental before making the change and seek approval retrospectively.

2.17 The hirer acknowledges that unauthorized modifications resulting in damage to the bike or other losses may incur additional charges for compensation, repair, or replacement of parts, as determined by Reynes Cycling Bike Rental.

2.18 In the event of physical damage to bike components or unauthorized major modifications made by the hirer without prior approval from Reynes Cycling Bike Rental, compensation will be calculated as follows:

  • Component Prices:

    • Compensation for damaged or modified components will be based on the Manufacturer's Suggested Retail Price (MSRP) or Publicly Displayed Price (PVP) for the respective components, as provided by the manufacturer.

  • Reparation Costs:

    • In addition to component prices, compensation will also include the current rate of labor required for repairs or replacements, as determined by Reynes Cycling Bike Rental.

  • Determination of Compensation:

    • Compensation for damages will be calculated based on the above-mentioned factors and may also include any associated costs incurred by Reynes Cycling Bike Rental in restoring the bike to its original condition.

  • Notification and Approval:

    • The hirer must notify Reynes Cycling Bike Rental before making any modifications to the rented bike and obtain approval for the proposed changes. Failure to do so may result in additional charges and penalties.

  • Value Depreciation:

    • Any modifications or damages that decrease the value of the bike will be considered as physical damage and charged accordingly, in accordance with the rules and policies of Reynes Cycling Bike Rental.

3. PAYMENT TERMS

3.1 Deposits are collected during the booking of the bikes on the website, phone, and email via online payment. The amount of the booking deposit on 27.01.2023 is 30% and it could be revised. This deposite is refundable and our cancellation policy is as follows:

  • Up to 4 weeks before the hire date or event - 100% refund of deposit.

  • Up to 3 weeks before the hire date or event- 50% refund of deposit.

  • Up to 14 days before the event or hire date - 0% refund of deposit.

3.2 In consideration of our arranging and fulfilling your Hire by these terms and conditions you will pay REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) the 30% booking deposit for your period of Hire in advance of the hire commencing. The Outstanding payment will be processed during the pick-up or bike's delivery.  

3.3 Late return of the Bike will be charged at twice the published daily hire rate for each day/ part day that the bike is returned late.

3.4 A Credit Card will be required at the commencement of any hire period, but this may extend to a deposit to the value of the cycle(s) by credit or debit card payment or other surety as deemed sufficient by REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) depending on REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) assessment of the risk and the value of the equipment.

3.5 If the terms set out in 3.4 (above) are not complied with, REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) reserve the right to charge reasonable charges until such time when cycles and/or equipment concerned have been returned to REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228). In the case of cycles and/or equipment left or returned damaged, you are responsible for any costs incurred and sustained in replacing or repairing (whichever the cheaper) the items concerned to a condition equivalent to that prior to the Hire.

3.6 In all cases normal wear and tear as defined by the products manufacturer or supplier is accepted and allowed and is included in any hire price

4. PERSONAL SAFETY

4.1 It is the rider’s responsibility for their own safety. Cycling involves personal risk and you must ride responsibly.

4.2 Injury(s) and/or death associated with the sport of cycling may result from weather, excessive speed, collision with inanimate objects or other persons, rider inexperience, error or abuse of equipment.

4.3 First time of novice bikers should use the equipment under the supervision of an experienced rider.

4.4 You must not cycle under the influence of alcohol, strong medication, other drugs or fatigue.

5. OUR LIABILITY TO YOU

5.1 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) does not accept responsibility for death, personal injury and direct loss suffered by you.

5.2 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) will not be liable to you where any alleged loss or damage results from;

  • Any of your own actions or omissions;

  • The action or omission of a third party not connected with the provision of your bike hire:

  • An event or circumstances which we could not have predicted or avoided even after taking all reasonable care;

  • Where any loss or damage is considered to be indirect or consequential loss.

5.3 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228)’s total liability to you under this contract between us shall be limited to the total cost of your Booking.

5.4 REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) shall have no liability to you if we are unable to fulfill a Booking due to an event of Force Majeure. In the event of REYNES CYCLING BIKE RENTAL (Deia Activity S.L., CIF B16607228) being unable to fulfill your booking our liability to you shall not exceed to the agreed cost of the hire. In cases of Force Majeure/Acts of God cancellations will not be permitted but it will be possible to reschedulen any booking to a later date.

6. GENERAL

6.1 These terms and conditions constitute the entire agreement between us, and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.

6.2 Any notice required or permitted to be given by either of us to the other under these terms and conditions shall be in writing.

6.3 No failure or delay by either of us in exercising any of its rights under these terms and conditions shall be deemed to be a waiver of that right, and no waiver by either of us of any breach of these terms and conditions by the other shall be considered as a waiver of any subsequent breach of the same or any other provision.

6.4 If any provision of these terms and conditions is held by any court or other competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these terms and conditions and the remainder of the provision in question shall not be affected.

6.5 Except as otherwise expressly provided herein, nothing in these terms and conditions confers or purports to confer on any third party any benefit or any right to enforce any of these terms or conditions.

6.6 These terms and conditions shall be governed by Spanish law, and both of us hereby agree to submit to the exclusive jurisdiction of the Spanish Courts in the province of Illes Baleares.
